The firm traces its origins back to the late 1890s, a generation after the Civil War.  Saner Avenue in Dallas was named for R.E.L. Saner.  In the late 1950s/early 1960s, the practice began to focus on municipal law.  The then-managing partner and firm’s namesake, H. Louis Nichols, was the Dallas Bar Association’s president in 1963 when President John Kennedy was assassinated.  Shortly after Lee Harvey Oswald’s arrest, Mr. Nichols held a private interview with Oswald, where he was assured by Oswald that he did not want legal representation from the Dallas Bar.

 

Many of the suburban cities surrounding Dallas retained the firm when they were first incorporated as small towns.  The firm has enjoyed the privilege of being the city attorney for some cities for generations.  The firm has been the city attorney for Richardson and Duncanville since before the Vietnam War.  The firm has represented the Dallas Central Appraisal District since its inception in 1982. 

 

The firm’s offices have always been located in downtown Dallas.  In 1984, after occupying the 12th floor of the Republic Bank Building for many years, the firm relocated to Ross Tower (formerly Lincoln Plaza) in the heart of the Downtown Dallas Arts District.  With access to both the free McKinney Avenue Trolley and the DART Light Rail’s Red, Blue, Green, and Orange Lines, we provide convenient, quick, and easy access both for our clients and our staff.  

Because of its many years of municipal representation, Nichols Jackson has been a part of the evolution of municipal law in Texas.  Some examples of cases handled by the firm are:

  • The 1970 landmark case of City of Hutchins v. Prasifka, which held that the doctrine of estoppel does not apply to cities, was handled by the firm.  
  • The firm represented Addison in City of Addison v. Dallas Independent School District, a 1982 case that held that zoning ordinances are subservient to the use of the property by independent school districts.  
  • The firm represented the City of Richardson in Responsible Dog Owners v. City of Richardson, a 1990 Supreme Court case involving the validity of an ordinance prohibiting pit bulldogs. 
  • The firm represented the Town of Talty in Hartsell v. Town of Talty, a seminal case under Texas’ vested rights statute.  The court’s holding was that a preliminary plat application is a “permit” for building purposes and that vested rights attach to a subdivision project from the time that the preliminary plat application is submitted through the construction of homes.  
  • In Rowlett/2000 v. City of Rowlett, the firm was successful in defeating a claim for inverse condemnation arising from the City’s refusal to down-zone a developer’s land from one-acre minimum lot sizes.  
  • In 2009, The firm represented DeSoto in City of DeSoto v. White, a complex employment law case in which the Supreme Court held that a city’s failure to inform a civil service police officer of his right to appeal was not jurisdictional or fatal to the City’s case.
  • In 2012, the firm represented the Dallas Central Appraisal District in Dallas Central Appraisal District v. Southwest Airlines Co., where millions of dollars in ad valorem taxes were at stake.  The Court rejected Southwest Airlines’ claim for a refund of taxes 
  • The firm represented the City of Richardson in the seminal 2018 case of City of Richardson v. Oncor Electric Delivery Company where the Texas Supreme Court held that Oncor, not the City, is required to pay the cost of the relocation of utility facilities in public rights of way to accommodate a public improvement project.
  • In 2019, the firm successfully represented the City of Rowlett in KMS Retail v. City of Rowlett, a landmark condemnation case involving the use of the eminent domain for economic development.
